• “Farmer” refers to a User who lists organic produce for sale.
• “Consumer” refers to a User who purchases or seeks organic produce.

• Use the Platform for lawful purposes only.
• Provide accurate and truthful information in all interactions (e.g., account details, product listings, organic certifications).
• Comply with all applicable local, state, and federal laws, including food safety regulations (for Farmers).
  2.3. Prohibited Conduct: You may not:
• Post false, misleading, or fraudulent content (e.g., inaccurate product descriptions or reviews).
• Engage in harassing, defamatory, or offensive behavior.
• Attempt to hack, disrupt, or bypass Platform security measures.
• Use the Platform to distribute spam or unauthorized advertisements.

• Maintaining the confidentiality of your account credentials.
• All activities conducted under your account.
• Notifying us immediately at hello@organicproducefinder.com if you suspect unauthorized access.
  3.3. Account Suspension: We may suspend or terminate your account if you violate these Terms or engage in behavior that harms the Platform or other Users.

• Provide accurate descriptions of produce, including availability, pricing, and organic certification status.
• Fulfill orders promptly and in accordance with Consumer expectations.
• Comply with all applicable food safety and agricultural regulations.

4.3. Consumer Obligations: Consumers agree to:

• Pay for orders as listed at the time of purchase.
• Provide accurate delivery or pickup information.

4.4. Payments: Payments are processed through third-party payment processors (e.g., Stripe). Organic Produce Finder is not responsible for payment disputes or errors caused by third parties.

4.5. Refunds: Refunds are issued at the discretion of Farmers. Organic Produce Finder is not responsible for refund disputes.

4.6. Pricing: Farmers set their own prices. Organic Produce Finder is not responsible for pricing disputes.

5. User-Generated Content

• Is false, misleading, or fraudulent.
• Violates intellectual property rights, privacy, or other laws.
• Is defamatory, obscene, or harmful.

5.3. Content Removal: We may remove or edit content that violates these Terms or harms the Platform’s integrity, at our sole discretion.

• Violate these Terms.
• Engage in fraudulent, abusive, or illegal activity.
• Fail to meet transaction obligations (e.g., non-payment or non-delivery).

9.3. Effect of Termination: Upon termination, your right to use the Platform ceases, but these Terms’ provisions on intellectual property, liability, and indemnification survive.

10. Governing Law and Dispute Resolution

• Direct Interactions: When you register, log in, fill out forms, make purchases, or communicate with other users (e.g., farmers or consumers).
• Location Services: When you enable location tracking on your device to find nearby farmers or markets.
• Automated Technologies: Through cookies, Google Analytics, or similar tools that track usage and performance on the Platform.
• Third Parties: From service providers like payment processors (e.g., Stripe) or analytics providers, who share data necessary to operate the Platform.

• Facilitate connections between farmers and consumers, including matching consumers with nearby farmers.
• Verify farmer listings and ensure accurate product information.
• Send account updates, or promotional emails (with your consent, where required).
• Personalize your experience, such as recommending farmers or products based on your location or preferences.
• Analyze and improve the Platform’s functionality, security, and user experience.
• Comply with legal obligations, such as tax reporting or responding to legal requests.

• Other Users: Limited information (e.g., delivery address or contact details) is shared between farmers and consumers to facilitate the chat function.
• Service Providers: Third parties that support our operations, such as:
  • Payment processors (e.g., Stripe) to handle transactions.
  • Hosting or cloud storage providers to store data.
  • Analytics providers (e.g., Google Analytics) to track usage.
• Legal Authorities: When required by law, such as in response to a subpoena, court order, or regulatory request.
• Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred to a successor entity.
  We do not sell your personal information to third parties for marketing purposes.

• When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

  An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

• If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

• Your information is stored on secure servers using industry-standard measures, such as encryption and access controls, to protect against unauthorized access, loss, or misuse.
• We retain your data only as long as necessary to fulfill the purposes outlined in this policy or as required by law (e.g., for tax or audit purposes).
